XMITEK IOT TECHNOLOGY CO., LIMITED (hereinafter "XMITEK"), the provider of the Koobird products and services, is committed to protecting your privacy and handling your personal information responsibly.
This Privacy Notice describes the types of personal information we obtain about consumers and other individuals as identified below, how we may use such personal information, with whom we may share it, and the available choices regarding our use of the information. This Privacy Notice also explains the measures we take to protect personal information, and how individuals can contact us regarding our privacy practices.
We collect certain personal information related to the products and services we provide. The types of personal information we obtain include the following:
Contact information, such as name and email address.
Account information, such as online passwords and other login credentials used to access Koobird products and services.
Payment information, such as name, billing address, and payment card details including card number, expiration date, and security code. These details are collected and stored by our third-party payment processors on our behalf. Koobird only stores the last four digits and expiration date of your payment card, and does so only when you purchase a subscription service.
Geolocation information of your mobile device, if you enable location services and consent to such collection.
Product settings information, such as your Koobird product's name, description, installation location, and any adjustments you make to its settings.
Technical information about your Koobird product, such as your Wi-Fi network details and signal strength (used solely to enable device connectivity), as well as your Koobird product's model, serial number, and software version.
Data about your interactions with our mobile applications.
Information obtained from third-party business partners, such as your account ID, account name, and email address, when you choose to use third-party integration services.
Other personal information contained in the content you submit to us, such as information provided through our "Support" feature.
In addition, our products and services are designed to enable you to see and hear anyone outside your door and communicate with them via your mobile device.
To provide these services, we collect the content (and related information) captured and recorded when you use our products and services — such as video or audio recordings, live video or audio streams, images, and environmental data collected by our products to perform their functions (for example, motion, events, temperature, and ambient light).
The privacy, data protection, and video surveillance laws applicable in your jurisdiction may govern your use of our products and services. You are the data controller of the personal information you collect when using our products and services (for example, video or audio recordings, live streams, images, and data collected from the surrounding environment by our products).
You are responsible for ensuring that your use of our products and services complies with applicable laws. For example, you should post a notice or otherwise inform visitors, where required by law, that recording is in use. Capturing, recording, or sharing video or audio content involving others, or capturing others' biometric information or facial recognition data, may affect their privacy and data protection rights.
When you interact with our products and services, we automatically collect certain information through technologies such as network server logs, web beacons, and other automated methods. We may use these technologies to collect information about your device, browsing behavior, and usage patterns for the purpose of improving functionality and user experience.
The information we obtain in this manner may include your device's IP address, identifiers associated with your device, device type, browser characteristics, language preferences, referring and exit pages, clickstream data, and the dates and times of access. This information is collected in a de-identified or aggregated form and is not used to personally identify you.

Identifying and verifying your identity, and preventing unauthorized access to your account or data;
Enhancing and maintaining the security of our products and services and preventing misuse;
Communicating with you, including providing offers and updates about our products and services—with your consent where required by law, and delivering customer support;
Allowing you to interact with certain third-party or connected products and services (for example, integrations you enable with non-Koobird devices or platforms);
Performing analytics (including market and consumer research, trend analysis, and financial analysis) for product improvement and business operation purposes;
Operating, evaluating, developing, managing, and improving our business (including managing, analyzing, and enhancing our products and services; developing new products and services; evaluating the effectiveness of our communications; conducting accounting, auditing, billing, reconciliation, and collection activities, and other internal functions);
Protecting against, identifying, and preventing fraud, criminal activity, claims, and other liabilities;
Complying with and enforcing applicable legal requirements, relevant industry standards, and our policies, including this Privacy Notice and our Terms of Service, or as otherwise permitted by law.
We may also use the information we collect about you in other ways, for which we will provide a specific notice at the time of collection and, where required by law, obtain your consent.
We also use third-party web and app analytics services on our mobile applications. Some of these third-party services use automated technologies to collect and analyze information, including personal data (such as IP addresses), on their own behalf, to help us understand how you use our mobile applications. These analytics services assist us in improving functionality and ultimately optimizing the customer experience. We encourage you to review the privacy policies of these analytics providers to understand their data handling practices and, where available, learn how to opt out of such data collection.
We do not sell or share personal information about you as defined under applicable privacy laws, including the California Consumer Privacy Act (CCPA) and similar regulations, except as described in this Privacy Notice. We may share your personal information with the following parties:

(5) in other situations with your explicit consent.
If we sell or transfer all or part of our business or assets (including through a merger, acquisition, joint venture, reorganization, divestiture, dissolution, or liquidation), we reserve the right to transfer any information we hold about you as part of that transaction, provided that the recipient agrees to handle your personal information in a manner consistent with this Privacy Notice.
We provide you with certain choices regarding how we collect, use, and share the personal information we obtain about you. You may choose not to receive promotional communications from us by following the unsubscribe instructions included in our emails or by adjusting your communication preferences within our mobile application. We may still send you certain service-essential communications about our products and services (for example, billing or account-related information), which are necessary for providing the service and cannot be opted out of.
If you subscribe to our Premium Plan, you may manage or cancel your subscription at any time through your account settings. We provide you with options regarding the personal information we collect from you. To update your preferences, limit the communications you receive from us, or submit a request to access, correct, or delete your personal data, please contact us as described in the "How to Contact Us" section of this Privacy Notice.
Additionally, to the extent required by applicable law, you may have the right to request access to, correction of, or deletion of your personal data. Our products, services, or websites may allow you to link or integrate with third-party services through APIs or other means to enable certain features or experiences. For example, you may connect your Koobird device or account to third-party platforms (such as Amazon, Google Home, or other smart home ecosystems that integrate with Koobird products).
These third-party services and features operate independently from us, and we do not control, operate, or endorse them. Their privacy practices—including details about the information they may collect about you—are governed by their own privacy notices, and we strongly encourage you to review those policies carefully before enabling integrations.
If any linked online service or third-party feature is not owned or controlled by us, Koobird disclaims any liability for the information practices or data processing activities of those third parties.
By using or engaging with such services and features, you are requesting and authorizing us to transmit or provide access to certain information on your behalf—such as your account ID, email address, or usage data—only as necessary to enable the feature and in accordance with your consent.
We have implemented administrative, technical, and physical safeguards to protect and maintain the security of personal information, including the use of encryption, access controls, secure data storage, and regular security assessments, against accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure, or use.
We may update this Privacy Notice periodically to reflect changes in our personal information practices, and will provide reasonable notice where required by law. We will post a notice on our website and mobile applications to inform you of any material updates and will indicate both the effective date and the last updated date at the top of this Notice. Your continued use of our products or services following the posting of an updated Privacy Notice constitutes your acknowledgment and acceptance of the revised terms.
